On 15 November 2022 Elizabeth Devine presented a paper on the topic of ‘Bullying, Discrimination and Harassment in Legal Practice’ for the Television Education Network. As in the broader society, bullying, discrimination and harassment is nothing new in the legal profession and has remained pervasive despite 40+ years of anti-discrimination legislation, 20+ years of enterprise specific work health and safety legislation and it being a condition of practice that solicitors and barristers not engage in this conduct. The paper provided a snapshot of bullying, discrimination and harassment in the legal profession and explained what each of these behaviours is in a legal context. It then endeavoured to answer the question – why does bullying, harassment and discrimination prevail in the legal profession and what can be done about it?
