On 18 October 2019 Elizabeth Devine presented a paper at Television Education Network’s Mental Health Master Class on the topic of ‘Addictions and the Workplace’. The paper began with an overview of the use of alcohol and drugs in Australia and then proceeded to a discussion of the legal framework in which addiction and substance abuse is managed in the workplace. The question of when drug and alcohol testing is reasonable was then explored, having particular regard to a range of different scenarios the Fair Work Commission and Federal Court have had to consider. The complex and detailed task of developing, implementing and enforcing a drug and alcohol policy was then examined in detail. The many challenges associated with the management of drug and alcohol risks in the workplace was highlighted, including the tension between workplace safety and the personal boundaries of employees, the significant limits of drug testing, the scientific debate regarding what is the best method of drug testing and the realities of human behaviour and experience.
